Yes, he used Morfin’s wand, but the first time Harry got a warning, it was Dobby who did magic. So anything in Tom’s vicinity while he was in a Muggle residence, including his own magic, should have registered with the Trace.

Was the Trace not a thing in the 1940s?

Or... did he figure out how to remove it?

Or perhaps the Ministry is just incompetent. Who knows?
